The following terms and conditions apply to any purchases of art supplies and/or other products that you ("Customer") make from us, Montana Colors N. A. Inc. ("Montana"), through this web site. By ordering products through this web site or by accepting delivery of products ordered, you accept and agree to be bound by these terms and conditions. Montana reserves the right to modify or change these terms and conditions at any time without notice.
 
Prices, Shipping, Handling, Returns and Taxes. All prices do not include charges for shipping and handling, taxes, or other similar charges or fees, for which Customer shall be responsible and which shall be separately charged on any invoice. Customer shall be responsible for all sales, use, and other taxes associated with an order; currently, Montana is required to charge and withhold sales tax for delivery within California. Returns are only accepted for defective merchandise. Defective merchandise must be returned to us un-used and un-damaged The customer must pay for shipping the product back to us. We will pay the shipping to you for the replacement merchandise. At the time we receive your products at our location and we do not have your item in stock we reserve the right to substitute an item or paint color of equal value. We will do our best to match colors as closely as possible.
 
Payment.
Payment shall be made by credit card, unless otherwise indicated on this web site, and must be received by Montana prior to the acceptance or shipment of Customer's order. We accept Visa, American Express and MasterCard. We do not accept personal checks or International credit cards and cannot accept credit cards with billing addresses outside of the United States and Canada.
 
Montana validates your credit card by checking your personal billing information, and thus we require you to enter the billing information as it appears on your credit card statement before we authorize your purchase. We only charge your credit card when we ship the item. When you place your order, we pre-authorize your credit card to make sure the funds are available. Please Note: the pre-authorization may look like a debit on your account and we won't actually debit your account until we ship your order. If we have to ship items in your order separately, more than one charge may show up on your card unless authorized to run the full purchase amount. If we have to cancel your order, the amount of time it takes to credit your account depends on the issuer of your card.
 
Limitation of Liability.
CUSTOMER'S SOLE REMEDY FOR ANY BREACH OF THESE TERMS AND CONDITIONS BY MONTANA SHALL BE A REFUND OF THE PURCHASE PRICE PAID. MONTANA'S TOTAL, AGGREGATE LIABILITY SHALL NOT IN ANY EVENT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER FOR ANY PRODUCTS PURCHASED HEREUNDER. IN NO EVENT SHALL MONTANA BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, INCLUDING ANY LOST PROFITS OR LOSS OF BUSINESS, OR FOR ANY CLAIM BY ANY THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.
 
Miscellaneous.
Policies, item availability, and prices are subject to change without notice. Products purchased from Montana Colors are not for resale unless proper documentation is provided, and Customer agrees that any products it purchases are only for personal use. These terms and conditions and any orders or purchases from this web site shall be governed by the laws of the state of California, without regard to its conflicts of laws rules.
