Terms and Conditions PLEASE TAKE A MOMENT TO READ THE FOLLOWING TERMS AND CONDITIONS, WHICH APPLY TO ALL ORDERS AND PURCHASES. The following terms and conditions apply to any purchases of art supplies and/or other products that you ("Customer") make from us, Montana Colors N. A. Inc. ("Montana"). By ordering products or by accepting delivery of products ordered, you accept and agree to be bound by these terms and conditions. Montana reserves the right to modify or change these terms and conditions at any time without notice. Prices, Shipping, Handling and Taxes All prices do not include charges for shipping and handling, taxes, or other similar charges or fees, for which Customer shall be responsible and which shall be separately charged on any invoice. Customer shall be responsible for all sales, use, and other taxes associated with an order; currently, Montana is required to charge and withhold sales tax for delivery within California. Payment Payment shall be made by credit card, unless otherwise indicated on this web site, and must be received by Montana prior to the acceptance or shipment of Customer's order. We accept American Express, Visa and MasterCard. We do not accept personal checks, purchase orders, or International credit cards. We cannot accept credit cards with billing addresses outside of the United States. Montana validates your credit card by checking your personal billing information, and thus we require you to enter the billing information as it appears on your credit card statement before we authorize your purchase. We charge your credit card when we ship the item. If we have to ship items in your order separately, more than one charge may show up on your card unless authorized to run the full purchase amount. When you place your order, we pre-authorize your credit card to make sure the funds are available. Please note: if you use a debit card, the pre-authorization may look like a debit on your account. We won't actually debit your account until we ship your order. If we have to cancel your order, the amount of time it takes to credit your account depends on the issuer of your card. Limitation of Liability CUSTOMER'S SOLE REMEDY FOR ANY BREACH OF THESE TERMS AND CONDITIONS BY MONTANA SHALL BE A REFUND OF THE PURCHASE PRICE PAID. MONTANA'S TOTAL, AGGREGATE LIABILITY SHALL NOT IN ANY EVENT EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER FOR ANY PRODUCTS PURCHASED HEREUNDER. IN NO EVENT SHALL MONTANA BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, INCLUDING ANY LOST PROFITS OR LOSS OF BUSINESS, OR FOR ANY CLAIM BY ANY THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS. Miscellaneous Policies, item availability, and prices are subject to change without notice. Products purchased from Montana Colors are only for personal use and are not for resale unless proper documentation is provided by Customer in the form of a certificate of resale. Wholesale products are not for gift giving or personal use. Montana reserves the right to terminate any distributor account found to be violating this agreement. These terms and conditions and any orders or purchases from this web site shall be governed by the laws of the state of California, without regard to its conflicts of laws rules. |
